Terms and Conditions

This is an English translation for your convenience. Only the German version is legally binding: Allgemeine Geschäftsbedingungen (AGB).

§ 1 Scope

These General Terms and Conditions apply to all contracts between Patrick Rupp · PR Arts (pr-arts.de) and its customers for photo shoots, workshops, studio bookings, gift vouchers, livestream tickets and course videos, whether concluded via this website or by other means.

§ 2 Conclusion of contract

The presentation of our services on the website does not constitute a binding offer. By booking or purchasing online, you submit a binding offer. The contract is concluded with our booking confirmation by email or upon successful payment.

§ 3 Prices and payment

The prices stated at the time of booking apply. All prices are gross prices including statutory VAT. Payment is processed by the payment service provider Mollie B.V. (credit card, SEPA direct debit, PayPal, instant bank transfer and others). The service is only provided, or your place reserved, once payment has been received in full.

§ 4 Studio bookings

Booked studio times start and end at the booked times. Overruns are charged per half hour or part thereof at the applicable hourly rate, provided the following slot is available. The studio must be treated with care; the person who made the booking is liable for any damage caused by the hirer.

Cancelling a studio booking

Free cancellation up to 7 days before the appointment. Cancellation 2–7 days before: 50% of the booking amount. Cancellation less than 48 hours before, or no-show: 100% of the booking amount. Cancellations must be made in writing by email to info@pr-arts.de; the time the email is received is decisive.

§ 5 Workshops

The number of participants is limited; places are allocated in the order in which payments are received. Participation is binding once a ticket has been purchased.

Cancelling a workshop

Cancellation up to 14 days before the start of the workshop: 50% cancellation fee, 50% refund. Cancellation less than 14 days before the start of the workshop: no refund. Your place can be transferred to another person by prior arrangement. If we cancel (e.g. too few participants, illness of the instructor), the full amount will be refunded.

§ 6 Photo shoots

Scheduled photo shoots can be cancelled free of charge up to 7 days before the appointment. For later cancellations or no-shows, a cancellation fee of 50% of the agreed package price may be charged. Preparations required for the shoot (styling, backgrounds, props) are agreed separately.

Additional images and extensions

Images beyond the number included in the package cost €35.70 each (€30.00 plus 19% VAT). They can be ordered during the image selection or later. If the shoot is extended beyond the time agreed in the package by mutual agreement, we charge €110 per hour including VAT, billed per half hour or part thereof (€55).

§ 7 Gift vouchers

Gift vouchers are valid for 3 years from the date of issue (statutory standard limitation period). They are transferable but cannot be exchanged for cash. Any remaining balance is kept and can be redeemed later.

§ 8 Livestream tickets and course videos

Livestreams and course videos show artistic nude photography. Only persons aged 18 or over may buy and watch them.

Livestream tickets

After payment, you receive a personal access link by email. The livestream takes place at the stated date and time on live.pr-arts.de. The link is valid for one session: if it is opened a second time, the first session ends.

Course videos

After payment, you receive a personal access link by email. You can watch the video in your browser for 12 months from payment; the video cannot be downloaded. One playback at a time per link: if you start it on a second device, playback on the first one stops. Accompanying PDF files (e.g. the Lichtfibel) can be downloaded during the access period.

Use

Access links, livestreams, videos and PDF files are for your personal, private use only. You may not share the access link or record, copy or publish any content. In the event of misuse, we may block access.

§ 9 Image rights and use

The copyright in all images remains with Patrick Rupp. Customers receive the rights of use described in the respective package (usually private use). Any further use, in particular commercial use, requires a separate written agreement. We only publish customer images (e.g. on the website or on social media) with the express written consent of the person depicted.

§ 10 Liability

We are liable without limitation for intent and gross negligence and for culpable injury to life, body and health. Otherwise, liability is limited to typical, foreseeable damage. Liability for slight negligence is excluded unless essential contractual obligations are breached.

§ 11 Right of withdrawal

Consumers have a statutory right of withdrawal. The details are set out in our information on the right of withdrawal. For scheduled leisure events (workshops, studio bookings with a fixed date), the right of withdrawal is excluded under Section 312g (2) no. 9 of the German Civil Code (BGB).

§ 12 Final provisions

The law of the Federal Republic of Germany applies exclusively. The place of jurisdiction for merchants and for persons without a general place of residence in Germany is Heilbronn. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
